Licensed Application End User License Agreement

a. Scope of License

Licensor grants you a non-transferable, non-exclusive, revocable license to install and use InkTrace Stencil Studio on any Apple-branded products that you own or control, strictly as permitted by the Apple Media Services Terms and Conditions. This license also governs any software updates, add-ons, or enhancements provided by Licensor that replace or supplement the original version of InkTrace Stencil Studio, unless such update is accompanied by a separate license agreement.

You may not transfer, redistribute, or sublicense InkTrace Stencil Studio. If you sell or transfer your Apple-branded device to a third party, you must remove InkTrace Stencil Studio from the device prior to doing so.

• You may not copy (except as expressly permitted by this license and the Usage Rules), reverse-engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of InkTrace Stencil Studio, any updates, or any part thereof.
• You may not use InkTrace Stencil Studio for any unlawful purpose, in violation of any applicable regulations, or in a manner that infringes on the intellectual property rights of any third party.

b. Subscriptions and Financial Terms

InkTrace Stencil Studio operates under a freemium model. Core features, such as basic contrast tools and a limited quota of two (2) daily stencil extractions, are provided free of charge. Access to unlimited high-resolution stencil processing, multi-layer separation, multi-panel splitting, and specialized thermal printer profiles requires an active auto-renewing subscription (offered on a weekly or annual basis) or eligible in-app purchase.

Subscriptions and purchases are processed directly through Apple Media Services and your Apple ID account. Pricing is displayed within the application prior to purchase and may vary by region or currency conversion rates determined by Apple.

• Payment will be charged to your Apple ID account upon confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is cancelled or turned off at least 24 hours before the end of the current subscription billing period.
• Your account will be charged for renewal within 24 hours prior to the conclusion of the current period at the rate of the selected plan.
• You can manage your subscriptions and disable automatic renewal at any time by navigating to your Apple ID Account Settings on your device.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to the application.

c. Thermal Printers and Hardware Compatibility

InkTrace Stencil Studio provides features designed to transfer and print processed stencil files wirelessly to supported thermal tattoo stencil printers via Apple AirPrint and Bluetooth technologies. While InkTrace Stencil Studio includes pre-configured profiles and contrast calibrations optimized for popular thermal printing hardware (including third-party devices such as Ozer, Phomemo, and similar manufacturers), Licensor does not manufacture, service, or sell printer hardware.

Licensor makes no warranty or representation regarding the operational status, hardware longevity, mechanical reliability, or wireless performance of any third-party printer.

• Reference to third-party brand names, printer models, and trademarks is solely for compatibility identification and does not imply affiliation, sponsorship, or endorsement by those manufacturers.
• You are solely responsible for following hardware manufacturer guidelines, using suitable thermal transfer paper, and maintaining proper printer thermal head hygiene and temperature thresholds.
• Licensor shall not be held liable for any hardware malfunction, paper jams, thermal head overheating, mechanical breakdown, or loss of consumables resulting from print commands sent through the application.

d. User Content and Professional Stencil Application

You retain full ownership and intellectual property rights over all images, photographs, artwork, sketches, and tattoo designs that you import into or generate with InkTrace Stencil Studio ("User Content"). Stencil image processing, line thickness modulation, mirroring, and panel dividing are executed locally on your device or in designated secure application environments.

InkTrace Stencil Studio is a specialized production tool developed for professional tattoo artists and apprentices. The conversion of images into line art, mirroring, and page scaling tools are algorithmic aids. You maintain full professional responsibility for verifying the accuracy of the resulting stencil.

• You represent and warrant that you own or possess all necessary rights, licenses, consents, and permissions to import, modify, and reproduce any artwork or imagery processed through InkTrace Stencil Studio.
• You are solely responsible for inspecting stencil line fidelity, anatomical scaling, horizontal mirroring alignment, and transfer paper legibility prior to applying transfer fluid, placing the stencil on a client, or commencing tattoo work.
• Licensor disclaims any liability for tattoo application errors, incorrect anatomical placement, client dissatisfaction, skin reactions, or aesthetic discrepancies arising from your use of generated stencils.

e. Consent to Use of Data and Privacy

You agree that Licensor may collect and process technical data and related information—including but not limited to technical information about your device, operating system version, peripheral printer connectivity status, and application telemetry—that is gathered periodically to facilitate software updates, customer support, and application performance improvements.

Licensor does not claim ownership of or sell your private artwork. All data handling is conducted in accordance with our Privacy Policy and applicable data protection regulations.

• Technical diagnostic and crash reporting data may be collected in an anonymized or aggregated format that does not personally identify you.
• User Content imported into InkTrace Stencil Studio remains confidential to you and is not shared with third parties without your explicit authorization.

f. External Services and Third-Party Materials

InkTrace Stencil Studio may enable access to Licensor's or third-party online services, software libraries, and websites (collectively and individually, "External Services"). Use of External Services requires Internet access and may require you to accept additional terms of service.

Licensor reserves the right to modify, suspend, remove, limit, or disable access to any External Services at any time without notice. In no event will Licensor be liable for the removal of or disabling of access to any such External Services.

• Licensor does not warrant or endorse and does not assume any liability or responsibility to you or any other person for any third-party services, documentation, or printer firmware.
• You agree not to use the External Services in any manner that infringes or violates the rights of any other party, and that Licensor is not in any way responsible for any such unauthorized use by you.

g. Termination

This Custom EULA is effective until terminated by either you or Licensor. Your rights under this license will terminate automatically and immediately without notice from Licensor if you fail to comply with any of the terms or restrictions set forth in this agreement.

Upon termination of the license, you must cease all use of InkTrace Stencil Studio and permanently delete and destroy all copies, full or partial, of the application from all devices under your control.

h. Disclaimer of Warranties

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF INKTRACE STENCIL STUDIO IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INKTRACE STENCIL STUDIO AND ANY SERVICES PERFORMED OR PROVIDED BY THE APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO INKTRACE STENCIL STUDIO AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

• NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY LICENSOR, ITS AUTHORIZED REPRESENTATIVES, OR AFFILIATES SHALL CREATE A WARRANTY.
• LICENSOR DOES NOT WARRANT THAT THE OPERATION OF INKTRACE STENCIL STUDIO WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY THERMAL PRINTER MODEL OR BLUETOOTH FIRMWARE REVISION.
• SHOULD INKTRACE STENCIL STUDIO OR ITS ASSOCIATED SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

i. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR PERSONAL INJURY, PROPERTY DAMAGE, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, LOSS OF REPUTATION, EQUIPMENT FAILURE, MATERIAL LOSS, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE INKTRACE STENCIL STUDIO, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL LICENSOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT PAID BY YOU FOR INKTRACE STENCIL STUDIO OR ITS IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE OCCURRENCE OF THE LIABILITY, OR FIFTY UNITED STATES DOLLARS ($50.00), WHICHEVER IS LESS.

j. Export Compliance

You may not use or otherwise export or re-export InkTrace Stencil Studio except as authorized by United States law and the laws of the jurisdiction in which InkTrace Stencil Studio was obtained.

In particular, but without limitation, InkTrace Stencil Studio may not be exported or re-exported into any U.S.-embargoed countries or to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Department of Commerce Denied Persons List or Entity List. By using InkTrace Stencil Studio, you represent and warrant that you are not located in any such country or on any such list.

k. U.S. Government End Users

InkTrace Stencil Studio and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable.

Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

l. Governing Law and Severability

This Custom EULA and all disputes arising out of or related to your use of InkTrace Stencil Studio shall be governed by and construed in accordance with the laws of the jurisdiction in which Licensor is established, excluding its conflicts of law principles. Any legal action or proceeding arising under this agreement shall be brought exclusively in the competent courts located within the jurisdiction of the Licensor, and the parties hereby irrevocably consent to personal jurisdiction and venue therein.

If any provision of this Custom EULA is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remaining provisions of this Custom EULA shall continue in full force and effect.
